What the bid is for

The City invites proposals from qualified developers to finance, design, permit, construct, own, operate, maintain, and ultimately decommission a landfill gas beneficial use project at the North Montgomery Landfill. The City seeks a technically reliable and financially sustainable project that maximizes beneficial use of recoverable LFG while preserving landfill operations, regulatory compliance, public safety, and the City’s long-term flexibility.

The City presently anticipates the sale of raw LFG to the selected Developer. Proposers may submit an RNG project, another high-Btu beneficial use project, electricity generation, direct-use project, or another commercially demonstrated alternative, provided the proposer clearly states its commercial structure, environmental attributes, interconnection requirements, site requirements, and economic benefit to the City.

Scope

The City intends to negotiate a long-term agreement under which the Developer purchases or otherwise compensates the City for LFG accepted by the LFG Facility. The final structure may include a gas sale agreement, site lease, easements, interconnection agreement, environmental attribute allocation, performance security, and other documents. [...] The City will retain ownership of the landfill and the City-owned GCCS. The Developer will own the LFG Facility and Developer-installed equipment unless the final agreement states otherwise.

Developer Responsibilities

  • Perform all due diligence and independently evaluate LFG quantity, quality, variability, contaminants, recoverability, and commercial suitability.
  • Finance the Project without recourse to the City unless expressly agreed in writing.
  • Design, permit, construct, test, commission, own, operate, maintain, repair, replace, and decommission the LFG Facility.
  • Obtain all pipeline, utility, right-of-way, easement, environmental, building, fire, zoning, transportation, and other approvals required for the Project.
  • Maintain a reliable means for the City to route gas to a compliant control device whenever the LFG Facility is unavailable.
  • Provide complete operating data, downtime notices, alarms, calibration records, gas acceptance data, environmental attribute records, and reports specified by the final agreement.

At expiration or termination, the Developer shall, at its cost, safely shut down, decontaminate, remove, and lawfully dispose of Developer facilities and restore the Site unless the City elects in writing to accept specified assets.

Additional information

**Submission:** Submit four (4) bound originals, three (3) paper copies, and one searchable electronic PDF on a USB drive, or submit electronically through other means, as directed by the City. The outside package or electronic submission shall identify the RFP number, Project title, proposer, and due date. Late proposals may be rejected.

Proposals shall remain firm for at least 180 calendar days after the proposal due date unless the City agrees otherwise in writing.

**Proposals due 11/19/2026 at 2:00 PM.** Forms A through D must be completed and signed.
